Mobile Message Service

PawTenant’s mobile messaging service is operated by Klaviyo. By opting into or using the service, you agree to these Mobile Message Terms. PawTenant may change, suspend, or discontinue the service or its features without prior notice. If these terms are updated, continued use of the service after the changes take effect indicates acceptance of the revised terms.

PawTenant does not charge a separate fee for the messaging service. However, standard messaging and data rates from your wireless carrier may apply. Message frequency varies, and messages may be delivered using automated technology. Consent to receive text messages is not a condition of purchasing any goods or services.

You may opt out at any time by texting STOP to +1 (409) 965-5885. For help, text HELP to the same number or email hello@pawtenant.com.

You must provide an accurate, current mobile number. Wireless carriers are not responsible for delayed or undelivered messages, and PawTenant is not liable for delivery failures, message errors, or actions taken based on message content.

Limited Scope of Services; No Doctor-Patient Relationship

The PawTenant website provides educational and informational content about emotional support animals, psychiatric service dogs, housing accommodations, and related topics. The website does not itself provide medical or psychological advice, diagnosis, or treatment.

Accessing the website, reading its content, or communicating through the site does not automatically establish a doctor-patient, therapist-client, or other professional relationship between you and PawTenant or any affiliated individual or provider.

Even when website content is written by individuals with professional credentials or refers to clinical research, that content is provided for informational purposes unless a separate professional service is explicitly established. Website information should not replace advice from a qualified healthcare professional.

Providers who use or work with the site are responsible for the professional services they deliver, subject to applicable requirements and PawTenant’s quality control guidelines. PawTenant and third parties linked through the site are not responsible for damages arising from professional advice or services provided by others.

Provider availability and response times may vary. Any timeframes shown on the website are estimates, not guarantees.

For additional information, review our guides on how to get an ESA letter online and all about service dogs.

Refund and Cancellation Policy

Refund eligibility is governed by PawTenant’s Refund Policy, which contains the complete terms for refunds and cancellations.

In general:

  • ESA and PSD evaluations: A full refund is available if a licensed provider determines that you do not qualify, subject to the applicable Refund Policy.
  • Housing-denial claims: A landlord’s denial of an accommodation request does not automatically qualify you for a refund. PawTenant reviews the available evidence to determine whether its own guarantee applies; this review is not a legal determination.
  • Cancellation after clinical work begins: If you cancel after documented clinical work has started, including provider review, outreach, or a consultation, a $30 professional evaluation and administrative services fee is retained, with the remaining amount refunded. This fee does not apply to categories eligible for a full refund and is not triggered by order status alone.
  • Subscriptions and add-ons: These follow the specific terms stated in the Refund Policy.

You agree to provide accurate information, submit your accommodation request and PawTenant letter to your housing provider when applicable, avoid altering or misusing documents, and cooperate with refund reviews. A review may include verification of relevant documents and communications.

Any discretionary refund is a one-time courtesy and does not create an entitlement to future refunds. Nothing in these Terms or the Refund Policy limits rights available under applicable law or applicable card-network rules.

Notice for Residents of Arkansas, California, Iowa, Louisiana, and Montana

California law AB 468, effective January 1, 2022, establishes requirements for certain emotional support animal documentation involving dogs. Under the process described by PawTenant, eligible clients must have a client-provider relationship lasting at least 30 days before an ESA letter for a dog can be issued. This process involves two consultations.

A required waiting period does not mean that a provider has determined you do not qualify. If you cancel after documented clinical work has begun, the $30 service fee described in the Refund Policy may apply. Categories eligible for a full refund remain protected under that policy.

Requirements can vary by jurisdiction and individual circumstances. Review the relevant state information and seek qualified legal guidance if you have questions about how a law applies to your situation.

Site Content

PawTenant makes reasonable efforts to provide accurate and relevant website content but does not guarantee that all information is complete, current, or error-free. We may revise, add, remove, or discontinue website content or features at any time without prior notice.

The website and services are intended for users located in the United States. Anyone accessing the site from outside the United States does so at their own risk. PawTenant does not guarantee that its content or services comply with laws outside the United States.

User Accounts

When creating an account, you must provide your name, email address, password, and any other required information. You must be at least 18 years old and legally capable of entering into a binding agreement.

All information provided must be accurate, current, complete, and truthful. You are responsible for protecting your password and for activities conducted through your account.

Please notify PawTenant promptly if you suspect that your account has been lost, stolen, accessed without authorization, or otherwise compromised. PawTenant may take reasonable or necessary action to protect account security and the website.

The site and services are not directed to children. If PawTenant becomes aware that a user is under 18, it will take steps to delete that user’s data as described in its applicable policies and legal obligations.

Licenses

PawTenant grants you a limited, non-transferable license to access the website and use its services for personal, non-commercial purposes, subject to these Terms.

You must not:

  • Impersonate another person or misrepresent your affiliation.
  • Use the website to violate any applicable law.
  • Reverse engineer, decompile, or attempt to extract the website’s software.
  • Introduce viruses, malicious code, or other harmful technology.
  • Submit unlawful, abusive, defamatory, obscene, hateful, or privacy-invasive content.

PawTenant may remove content it considers inappropriate or take other action permitted under these Terms.

The website may contain links to third-party websites, platforms, or services. PawTenant does not control these external resources and is not responsible for their content, information, software, privacy practices, or availability. A link does not necessarily mean PawTenant endorses or guarantees the third party.

Some site features may allow you to share or export information to services such as Facebook, Instagram, or other platforms. When you choose to use those features, information may be transferred to the relevant service. Third-party platforms operate independently and are responsible for their own handling of information.

Intellectual Property Ownership

Website materials, including text, images, audio, video, software, graphics, and design elements, belong to PawTenant, its licensors, or the relevant content providers. These materials are protected by applicable United States and international intellectual property laws.

Except where ordinary use of the website or applicable law permits otherwise, you may not copy, modify, distribute, publicly display, republish, or create derivative works from website materials without the necessary permission.

Trademarks

Names, logos, designs, and other marks displayed on the website may be trademarks or service marks owned by PawTenant or other parties. You may not use these marks without written permission from the applicable owner. All rights in those marks remain with their respective owners.

Account Deactivation

You may request account deactivation and end your registration at any time by emailing hello@pawtenant.com.

PawTenant may suspend or terminate your account or access to the website where permitted under these Terms. We may retain, delete, or destroy communications and content in accordance with our internal policies, privacy practices, and applicable legal obligations.

Right to Modify

PawTenant may revise these Terms at its discretion. Updated Terms will be posted on the website, and continued use of the site or services after revised Terms take effect indicates acceptance of the changes, subject to applicable law.

We encourage users to review this page periodically to stay informed about current terms.

Disclaimer of Warranties

You use the website and services at your own risk. The website and services are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, to the fullest extent permitted by law.

PawTenant disclaims warranties including merchantability, fitness for a particular purpose, non-infringement, accuracy, system reliability, and freedom from errors or viruses.

PawTenant does not guarantee a particular legal outcome or that a landlord, airline, housing provider, or other third party will accept or recognize a document. An ESA letter does not guarantee approval of a housing accommodation, and emotional support animals do not have the same legal status or protections as service dogs in every situation.

An emotional support animal is not automatically a service animal. The rights and requirements that apply depend on the animal’s role, the setting, and applicable law. For more information, see our guide to service animals vs. emotional support animals.

Limitation of Liability

To the maximum extent permitted by applicable law, PawTenant and its affiliates, providers, and associated parties are not liable for indirect, incidental, special, consequential, or exemplary damages arising from your use of the website or services. Examples may include lost profits, lost goodwill, lost data, or other intangible losses.

To the maximum extent permitted by law, if PawTenant is found liable, its total liability is limited to the amount you paid for the specific product or service giving rise to the claim. Any claim must be brought within one year of the event giving rise to it, unless applicable law requires otherwise.

Nothing in this section excludes or limits liability that cannot legally be excluded or limited.

Subject to the exceptions and opt-out provisions in the Dispute Resolution section, you agree to bring claims in an individual capacity rather than as part of a class or representative action.

Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless PawTenant and its affiliates against claims, actions, demands, liabilities, settlements, and reasonable legal or accounting fees arising from:

  • Your violation of these Terms or applicable law.
  • Your reliance on website information.
  • Content or materials you upload or submit.
  • Your misuse of the website or services.

You also agree to indemnify providers against third-party claims arising from your use of information or advice they supplied, to the extent permitted by law.

PawTenant may assume control of the defense of a matter covered by this section. If it does, you agree to cooperate reasonably with that defense. You may not settle a covered claim in a way that imposes obligations on PawTenant without its written consent.

Dispute Resolution and Arbitration

General Agreement to Arbitrate

Except for the exceptions described below, you and PawTenant agree to resolve disputes arising from these Terms, your use of the website, or the services through binding individual arbitration.

By agreeing to arbitration, both parties waive the right to a jury trial and the ability to participate in class actions, subject to applicable law and the provisions of these Terms.

Exceptions to Arbitration

Either party may, where legally permitted:

  • Bring an individual claim in small claims court.
  • Seek enforcement through a government agency.
  • Request injunctive relief in court.
  • Bring a lawsuit involving intellectual property infringement.

Opt-Out Option

You may opt out of the arbitration agreement within 30 days after accepting these Terms by sending a written notice to PawTenant, Attention: Legal – Arbitration Opt-Out.

Your notice must include your full name, email address, and a clear statement that you wish to opt out of arbitration.

Arbitration Procedures

Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules and governed by the Federal Arbitration Act. Unless both parties agree otherwise, arbitration hearings will take place in Miami, Florida.

No Class Actions

To the extent permitted by law and subject to the exceptions and opt-out rights stated in these Terms, disputes must be brought individually rather than as part of a class, collective, or representative action.

Enforcement and Court Jurisdiction

If the arbitration provision is found unenforceable or you validly opt out, the Terms designate the state and federal courts located in Houston, Texas, as the exclusive courts for disputes, subject to applicable law.

Other Provisions

You may not transfer or assign your rights under these Terms without PawTenant’s written approval. PawTenant may transfer its rights as permitted by law.

These Terms are governed by Florida law, without regard to conflict-of-law principles, subject to any mandatory legal requirements that apply.

PawTenant may send legal notices electronically, including by email or through notices posted on the website. A notice is considered delivered when sent or posted as applicable, subject to applicable law.

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by law. These Terms constitute the complete agreement between you and PawTenant concerning your use of the website and services.

To report a potential violation of these Terms, email hello@pawtenant.com.
