What Maryland Landlords Can and Cannot Ask

Under the FHA and MFEPA, Maryland landlords may request a written ESA letter from a licensed mental health professional and may verify the professional's Maryland license through the Maryland Department of Labor's license lookup tool at dllr.state.md.us. They may ask the species of your ESA and request written confirmation of your accommodation request. Maryland landlords CANNOT charge pet fees, deposits, or monthly pet rent for your ESA; apply breed, size, or weight restrictions to your ESA; demand your specific mental health diagnosis, therapy notes, or medical records; require your ESA to wear a vest, be certified, or be registered in any database; retaliate against you for submitting an ESA accommodation request; or indefinitely delay responding to a written accommodation request. Montgomery County's Human Rights Law imposes stricter timelines on landlords than state or federal law — Montgomery County landlords who fail to respond within 30 days may be found in violation of the county ordinance.

Maryland University Housing: ESA Rights at UMCP, Johns Hopkins & UMBC

Maryland's major universities — the University of Maryland College Park (UMCP), Johns Hopkins University in Baltimore, University of Maryland Baltimore County (UMBC), Towson University, and Morgan State University — all have formal ESA accommodation processes through their disability services offices. UMCP's Accessibility and Disability Service processes ESA accommodation requests for all campus residential facilities in College Park, one of the largest public university campuses in the Mid-Atlantic. Johns Hopkins' Student Disability Services office handles accommodation requests for Hopkins residential housing in Baltimore's Charles Village neighborhood. UMBC's Accessibility and Disability Services manages ESA accommodations at the Catonsville campus. All Maryland university housing programs are subject to FHA reasonable accommodation requirements. Students should submit accommodation requests at least 4 weeks before move-in to ensure efficient processing.

Getting a Maryland ESA Letter in 2026

Maryland does not have additional state requirements beyond the FHA for ESA letters.
